TERMS & CONDITIONS FOR HIRERS

Please read these Terms and Conditions carefully and all other relevant information before booking. Any booking made directly with us or through our agents will be subject to these Terms and Conditions.

The holidaymaker is the person who signs the booking form or, in the case of online booking, the person who makes the online payment. This person is responsible for ensuring all members of the holiday party accept and adhere to these terms and conditions. The ‘holidaymaker’ is also referred to as ‘you’ and ‘your’ means all persons named on the booking form.

'We', 'us' and 'our' means Shoals Hook Farm, Shoals Hook Lane, Haverfordwest, Pembrokeshire. 'Owner' means the owners of the holiday accommodation. Unless the context otherwise requires, words in the singular shall include the plural and vice versa.

YOUR CONTRACT

Your contract is made directly with us, even if booking through our agents. All payments should be made to us in the manner specified on the booking confirmation.

Once the email is deemed received confirming the booking, all administration and communication with you is the responsibility of the property owners as this is the point that the contract is made between you and the Owner. It is your responsibility to check your emails regularly and to advise of any change to your email address.

WARRANTIES

The information on this website is provided by us. The information is given in good faith. We cannot accept responsibility for any changes or closures to local services or attractions.

LIABILITY

We cannot accept any liability for any loss or damage to your possessions, goods, vehicles or belongings whilst at the property. We suggest that you ensure that you have adequate insurance cover for your holiday.

We cannot accept any claim for personal injury. Internally the property conforms to the required standards of the Tourist Board for self-catering accommodation. Externally we are in the countryside, having 9 acres of grounds. These include natural hazards such as streams, ponds, woodland and steep slopes. We also have, from time to time, livestock on site – mainly sheep.

HIRER

All bookings are made subject to availability and only become firm when the deposit is accepted by us. The person booking (Party Leader) must be at least 18 years of age and have the requisite legal capability and authority to enter into a contract at the time of booking.

By making a booking the Party Leader confirms that they have authority to book on behalf of the party and that all other party members agree that the booking is subject to these Terms and Conditions.

Bookings cannot be accepted from parties of young people less than 18 years of age.

PAYMENT

All payments should be made to the Owner in the manner specified on the booking confirmation. The deposit, 25%, must be made within 7 days of making the booking. The booking will be held for that period only and if payment is not received by the time above the booking will be deemed to have lapsed. Bookings are considered provisional until the required deposit is paid, however you will be bound by these Terms and Conditions and could also be by your contract with the Owner. Non-payment of the balance of the rent on or before the due date (6 weeks prior to the arrival date) shall be construed as a cancellation of the contract by you.

Bookings made less than 6 weeks prior to the arrival date must be paid in full at the time of booking.

YOUR OBLIGATIONS

  • To pay before departure, or subsequently, for any breakages, losses or damage caused by you to the property or its facilities.
  • To take all reasonable and proper care of the property and leave it in a clean and tidy condition at the end of your holiday. You will be responsible for any additional cleaning costs.
  • To inform the Owner of any problems with the facilities or services as soon as they become apparent.
  • To permit the Owner reasonable access to the property to carry out urgent maintenance.
  • Not to sublet or share the property except with the persons included at the booking or subsequently included by agreement. The maximum number of persons allowed at the property is clearly stated and must not be exceeded. The Owner reserves the right to terminate hire without notice and without refund where this condition is breached.
  • Not to do or omit to do something which may be or become a nuisance to neighbouring holiday accommodation or properties. Quiet hours are from 22:00 to 08:00.

CANCELLATION

If you wish to cancel your booking you should advise the Owner as soon as reasonably practicable by telephone and follow this with confirmation in writing (or in the medium required by the Owner). The day of receipt of the written confirmation is the day that is deemed as the date of cancellation.

The Owner may (but without any obligation to you) use their best efforts to obtain a replacement letting. If a replacement letting is obtained for your booked full stay the Owner will refund to you any monies paid above the deposit less any handling charge.

If the Owner is unable to obtain a replacement, the Owner is entitled to retain all payments already paid and to recover the balance of the hiring charge. You are advised to obtain travel insurance to cover any unforeseen circumstances.

The Owner does not expect to have to make any changes to your booking, but sometimes problems occur and bookings have to be changed or cancelled or errors corrected. The Owner reserves the right to do so. If this does happen it is the duty of the Owner to contact the Party Leader (by telephone where possible for major changes and by post or email for minor changes) as soon as is reasonably practicable. The Owner will inform you of the situation and refund payments already made where the Owner must cancel through his/her actions or that of their employees or representatives. The property owner shall only be liable to return the monies received. No compensation or consequential losses shall be paid.

If the property is not available on the date booked and in the absence of fault by the Owner then no rent will be refunded. Neither the Owner nor their agents have liability or the requirement to pay compensation for any damage or loss as a result. We therefore recommend you take out adequate holiday insurance.

CARING FOR YOUR SAFETY AND COMFORT

The Owner makes every reasonable effort to indicate possible safety hazards in the property description. It is however your responsibility (particularly parents and anyone with physical restrictions) to inspect the property and grounds immediately upon arrival and note any possible hazards.

Please remember that although it is built to modern standards, it may contain potential hazards such as steep stairs and low ceilings which should be noted by you.

You must upon arrival check the layout of the property so that you have a planned route to exit the property as easily as possible in the event of an emergency.

The property is located in the countryside which can hold its own hazards such as barbed wire in fencing, slippy ground and animals in fields.

MISCELLANEOUS

Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.

The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required.

The property owner is entitled to ask the holidaymaker to leave the property without any refund if, in the property owner's opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.

The property owner reserves the right to refuse entry to anyone, who in the property owner's opinion is not suitable to or capable of taking charge of the property.

The property owner reserves the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by the property owner to be unreasonable.

NUMBER OF GUESTS

The maximum number of people entitled to stay at this property is 6 in Zinc and 4 in Cedar and furthermore, only those people named on the booking form are entitled to stay. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund. Sub-letting or assignation of the let is prohibited.

PETS

Pets are allowed in the property subject to the property owner's agreement. All pets must be house trained and the number and type of pet must not exceed what was agreed at the time of booking, otherwise a breach of contract will be deemed to have taken place.

Pets must not be left unaccompanied in the property at any time and must not be allowed on the beds. The holidaymaker shall be liable for all damage caused by his/her pet or any pet belonging to the holidaymaker's party. A charge will be made for any additional cleaning required. The property owner cannot be held responsible for any accident or injury to a pet during their stay.

ARRIVAL AND DEPARTURE TIME

Every effort will be made to have the property available from 16:00 on the day of arrival. The property must be vacated by 10:00 on the day of departure. Late departure will result in an additional charge being made. Information about keys and how to collect them will be provided once full payment has been received.

CLEANING

We would like to think the holidaymaker and party would treat the property as they would their own home and at the end of the holiday the property is left in a clean and tidy condition. The property owner retains the right to make an additional charge for cleaning should the property not be left in a similar condition to the way it was found at the start of the holiday.

BREAKAGES

The holidaymaker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages should be reported to the property owner (or their representative) prior to departure. The property owner retains the right to make an additional charge for damage and breakages although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the property owner) will not be charged for.

EV CHARGING

The owners must be notified at the time of booking if EV (electric vehicle) charging is required. Charging is monitored by a Smart Meter, which updates every 24 hours.

The cost of charging will be based on the current cost per kWh (including VAT) plus a 50% service charge.

For example, a 50kWh charge would cost £12.24 + 50% service charge = £18.36.

The cost of charging will be invoiced directly to you, the holidaymaker.

LIABILITY

The property owner takes no responsibility for the personal possessions of the holidaymaker or the holidaymaker's party. Vehicles and possessions are left entirely at the risk of the holidaymaker.

Children must be supervised at all times.

COMPLAINTS

As the property is in the countryside please note that regular country smells and noises will not be classed as cause for complaint.

If you do have cause for complaint, remedial action should be taken as soon as possible.

If you do have a cause for complaint regarding the property or the actions of the Owner or their representatives please inform the Owner as soon as you are able. Any complaints other than the initial booking are to be referred to the Owner with whom you have a contract.

As soon as a problem arises it is essential that you contact the Owner. Discussion with the Owner whilst you are at the property should enable the problems to be resolved straight away. If the problem is not resolved or you remain unhappy with the response you must rely on any statutory rights you have directly against the Owner. Any formal complaint in writing must be sent to the Owner within 7 days of the end of your rental period.
